1. Rights to Available Content;
All material on this blog is protected by international copyright and intellectual property laws and are the property of David Kamikaze. Unless stated otherwise, you may access and download the materials located on kamiongames.com for personal, non-commercial use. You may link to or republish content contained on this website as long as you include full credits to David Kamikaze (Kami) and a link to the original material.
Any commercial usage or reprinting must be verified with me first. Please don’t plagarise my content. It makes me a sad panda.
2. Blog Content;
Kamiongames.com is a blog and, this must be stressed, most of the content is the opinion of one man – with more than acceptable spare time on his hands. I do my very best to ground this opinion in as much factual data as possible, but of course, if you are allergic to opinion or unable to accept opinion, it may be a good idea to turn back now. Opinions are not the same as fact; we all have opinions. I consider factual basis to be legal documentation in .pdf formats, open statements from individuals and correspondence with individuals, sales and marketing data etc. I cannot always go back and edit blog posts as and when more evidence comes to the front; so please consider older posts to be older posts, where the accuracy may not be relevant any longer. I will try and keep language to a bare minimum – expect very mild cussing, PG-13 kind of stuff, but I won’t be going off on a vulgar rant. If you’re expecting the gaming equivalent of Charlie Sheen, I’m sorry. You will be disappointed.
3. Restrictions on Who can use this Blog;
Kamiongames.com is very accepting of comments; but I would kindly ask that those under 13 years of age just verify with their parents or legal guardians before posting. NEVER post personal information of any kind – including but not limited to; Address, telephone number, school/place of work, car registration number, mobile telephone number etc. This is common sense. Whilst I like seeing comments from people, please don’t spam. For example; please don’t state you are at college when you are linking to a time share holidays website. I reserve the right to decide what constitutes spam, and block access and decline comments accordingly. Please don’t assume for one moment I will be gentle on links, and with that said…
4. External Links
I am not responsible for the contents or reliability of any other websites to which links are provided. I may not share the views or opinions of any link that may be found in the comments sections, and will not be held liable for it. If in doubt, check the link at the bottom of your browser when you mouseover it. That said however, if links degrade and/or become home to nasty stuff, please feel free to drop me a note about it and I will make sure that it is deleted from the post, or the post itself is deleted.
5. Removing/reproducing material posted/sent privately.
Whilst I will try and accept as many comments as possible, sometimes I may decide a comment is too vulgar, excessive or may be promoting hatred or illegal activity, and in such cases I reserve the right to delete it without your consent. Public messages are available for all to see, so please don’t post anything you wouldn’t want your mother to know about. Private messages and e-mail conversations sent to me may be made publicly available should the need arise, as such you understand that by sending me this content that you are agreeing to grant me, free of charge, permission to make such information available. This is just to cover my back. Been in a dark place before with a well-known figure in the gaming world, and I endeavor never to get myself painted into that corner again.
6. Liability and Legal Jurisdiction
You must not use my blog in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity. The majority of comments are by members of the public. The views expressed are theirs and unless specifically stated are not those of myself. I accept no responsibility for any loss or harm incurred. I will at all times be bound by the laws of the United Kingdom, and as such will not tolerate content, links or private messages which contradict the laws of my country. The laws of England, Wales, Scotland and Northern Ireland govern the use of the site and you hereby agree to submit to the exclusive jurisdiction of the English courts should such a necessity arise. You will be liable for your own comments, I will do my very best to keep as much information private as possible, but it may not always be possible. Be aware that I will not sacrifice my blog to protect one or two users. I am not liable for the content of other sites who have linked to or are linked from the comments sections. I am not liable for any loss of information or untoward actions. Never download a file directly from this website – I won’t upload them to this site. I accept no responsibility or liability for those who foolishly download whatever links are provided to them.
7. Limiting liability for viruses, damage and availability
Whilst I will of course do my very best to make sure there is no untoward action and that links are kept clean, there is always an inherent risk on the internet that things can be corrupted, taken down and/or laced unintentionally with a bug or a virus. I will never link to any .exe or .zip file directly, and will always make sure if such things are necessary to upload them to a file-sharing medium that verifies that such things are virus-free. As I cannot accept responsibility for external files, you must acknowledge your own responsibility to make sure your firewalls, virus scanner, malware/adware blockers and pop-up/under killers are up to date. I cannot stress enough how dodgy the internet can be sometimes. Please protect yourself, I will do my best, but accept an advance apology if the worst should happen. I’ve tried. I really, really have.
Most of this is just covering my back. The vast majority of normal people will get along perfectly fine without actually breaking any rules, laws or causing any problems. The general gist of this is this; you accept posts are my opinion, you accept your comments are your opinion (and if they get you into big legal trouble, I may not be able to help you), and that I will delete spam where I think spam is placed. You can always poke me and ask why your post/comment was deleted. Deleted posts tend to be trashed seven days later, just to be on the safe side.
I want people to be able to feel they can comment, be honest and have a laugh and debate. Nothing more and nothing less. Just keep it PG-13 and we’ll all have a perfectly great time on this wide and scary internet.
Peace and cupcakes to you all,
